Terms of Service
These Terms govern your access to and use of Arca Budget, an envelope-budgeting application available on the web (the “Service”). The Service is operated by Takieddine Boumerah (Entrepreneur individuel (EI)), trading as Arca Budget, SIREN 931302947, France (“we”, “us”). By creating an account you enter into a contract with us on these Terms.
1. The Service is currently a free beta
Arca is in public beta. During this period the Service is provided free of charge, with every feature available, and we ask for no payment details of any kind. There is no trial running in the background, no countdown, and no automatic charge at any point.
Being a beta, the Service may contain defects, may be interrupted, and may change. We recommend that you export your data regularly and, above all, that you keep your recovery key somewhere safe.
2. What will happen when Arca becomes paid
Arca will become a paid service. We commit to the following, and these commitments form part of these Terms:
- you will be informed at least 60 days in advance, by email, with the exact price;
- nothing will be charged to you automatically. To become a subscriber you will have to place an order yourself, knowingly, through a compliant order process;
- if you do nothing, you are not charged: your budget becomes view-only — you can still browse and export it;
- your data is not deleted because you chose not to subscribe (see section 5).
Silence, or continued use of the Service, can never amount to acceptance of a paid subscription.
3. Your account
You must provide a valid email address and be at least 15 years old (the age of digital consent in France). You are responsible for the confidentiality of your password, your passphrase and your recovery key. One person, one account; do not share your credentials.
4. Encryption, and what it means for you
Your budget is encrypted on your device before being sent to us. We never hold your key. This is the core protection of the Service, and it has a direct consequence you must understand and accept: if you lose both your passphrase and your recovery key, your data is permanently unrecoverable — by you and by us. We cannot reset it, restore it, or bypass it.
5. Your data, and ending the Service
You may delete your account at any time from the app, which erases your data on our side. You may also export everything, at any time and for free, in an open format.
We do not delete your data because you chose not to subscribe. If we ever have to delete inactive accounts, we announce it well in advance with several reminders, and export remains available throughout. Retention periods are set out in our Privacy Policy.
We may close an account used for unlawful purposes, to attack or abuse the Service, or in breach of these Terms. Where circumstances allow, we give notice and leave you the opportunity to export your data.
6. Acceptable use
You agree not to attempt to bypass the security of the Service, to disrupt its operation, to access other users’ accounts, or to use the Service for unlawful purposes. Reporting a security flaw to us in good faith is welcome and will never be held against you.
7. Intellectual property
We retain all rights in the Service, including the software, documentation, branding and design. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal budgeting while these Terms are in force. Your data remains yours, and nothing here grants us any right over its contents — which we cannot read in any event.
8. Liability
During the beta the Service is provided as is, with no guarantee of availability or of the absence of defects. Arca is a budgeting tool: it provides no financial, tax or investment advice, and the figures it displays are those you enter yourself.
Nothing in these Terms limits our liability where the law does not permit it, in particular in cases of gross negligence or wilful misconduct, or in respect of your statutory consumer rights.
9. Changes to these Terms
We may amend these Terms to reflect changes in the Service or in the law. Any material change is notified by email before it takes effect. If you do not accept a change, you may delete your account and export your data.
For the avoidance of doubt: no amendment to these Terms can, by itself, make the Service chargeable to you. That requires a separate order placed by you (see section 2).
10. Governing law
These Terms are governed by the laws of France. As a consumer, you retain the benefit of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts having jurisdiction there.
